Sales of Mining Features (i.e. Tips, Shafts, Drifts/Adits)

There are a significant number of conveyances/transfers where the Authority (or it's predecessors British Coal/National Coal Board) included in the sale of land interests in mining features such as coal tips, mineshafts, drifts/adits. In such cases, it was usual to include title conditions (burdens) in respect of these mining features.

These title conditions are enforceable against the owner from time to time of the property. The right to enforce these title obligations passed to The Coal Authority by virtue of Restructuring Schemes made by the Secretary of State for Trade and Industry pursuant to powers under the Coal Industry Act 1994.
